Rubbish Collection Knightsbridge Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Knightsbridge provides waste and rubbish collection services to residential and commercial customers. By placing a booking, confirming a quotation, or allowing our operatives to carry out a collection at your premises, you agree to be bound by these Terms and Conditions.

Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means the person, company or organisation requesting or receiving the services of Rubbish Collection Knightsbridge.

Services means any waste, rubbish or junk clearance, collection, removal, loading, transportation or related services provided by Rubbish Collection Knightsbridge.

Waste means any items, materials, goods, refuse or other matter that the Customer asks us to remove as part of the Services, subject to applicable law and these Terms and Conditions.

Premises means the address or location where the Services are to be carried out.

Scope of Services

Rubbish Collection Knightsbridge provides rubbish and waste collection services within Knightsbridge and surrounding areas. Services may include one-off bulky waste removals, ongoing rubbish collections, office clearances, household clearances and related waste removal tasks. All Services are subject to availability, access, volume and type of Waste, as well as compliance with relevant waste regulations and health and safety rules.

We do not undertake services that fall outside our usual scope, such as specialist hazardous waste removals, unless expressly agreed in writing in advance. We reserve the right to refuse collection of any item or material that we reasonably believe may be unlawful to carry, hazardous to health or safety, or unsuitable for collection with the equipment and vehicles we are using.

Booking Process

Customers may request a booking by telephone, email or via any online enquiry system we make available. When you contact us, we may ask for details including your name, contact information, Premises address, description and quantity of Waste, access arrangements, and preferred collection dates and times.

Any quotation provided at the enquiry stage is an estimate only and is subject to confirmation upon arrival at the Premises. The final price may vary depending on the actual volume, type and weight of Waste, as well as the time taken to complete the collection and any additional Services requested on the day.

A booking is treated as confirmed when we have agreed a collection date and time window with you and, where required, received any requested deposit or pre-payment. We may confirm bookings verbally, by email or by other written communication. It is your responsibility to check the booking details and notify us promptly of any inaccuracies.

We aim to attend at the agreed time, but any times given for arrival or completion are estimates and are not guaranteed. Circumstances such as traffic, access constraints, operational delays or adverse weather may affect timings. We will use reasonable efforts to inform you of any significant delay or need to reschedule.

Access and Customer Responsibilities

The Customer must ensure that our operatives have safe, reasonable and lawful access to the Premises and to the Waste that is to be collected. This includes providing any necessary access codes, entry permissions, parking arrangements and clear pathways to the Waste.

Where parking charges, congestion charges, tolls or similar costs are incurred in order for us to complete the Services, these may be added to the final invoice. It is the Customer’s responsibility to obtain any permits or authorisations required for our vehicle to park or wait near the Premises.

You must ensure that the Waste to be collected is clearly identified and separated from any items that are not to be removed. We will not be held liable if items are removed which the Customer failed to distinguish from the Waste. Likewise, we are not responsible for any Waste left behind where the Customer did not make it accessible or clearly instruct us to take it.

Waste Regulations and Prohibited Items

Rubbish Collection Knightsbridge operates in accordance with applicable UK waste management legislation and duty of care requirements. We will transport collected Waste to licensed facilities for disposal, recovery or recycling, as appropriate.

Certain items cannot be collected as part of our standard Services, including but not limited to: asbestos, clinical waste, medical waste, pressurised containers, explosives, certain chemicals, oils, fuels, gas bottles, and other materials classed as hazardous or requiring specialist handling. If you are unsure whether particular items can be collected, you must contact us before the booking date for confirmation.

The Customer confirms that the Waste presented for collection is owned by the Customer or that the Customer has full authority to arrange for its removal. You must not request collection of any Waste that is unlawfully dumped fly-tipping or otherwise in breach of law. Once Waste has been collected and loaded onto our vehicle, ownership of that Waste transfers to Rubbish Collection Knightsbridge, and we will dispose of it in line with applicable regulations.

Pricing and Payments

Our charges are generally based on factors including the volume and weight of Waste, labour time, access difficulty, location, and any additional surcharges such as parking or congestion charges. Where possible, we will provide an indication of likely costs when you obtain a quotation. The final price will be confirmed by our team on site before work commences, once they have inspected the Waste and access conditions.

All prices quoted are exclusive of VAT unless stated otherwise. Any applicable VAT will be added to the final invoice at the prevailing rate.

Payment is due on completion of the Services, unless otherwise agreed in writing. We may accept payment by cash, bank transfer, card or other accepted payment methods, subject to availability. For business Customers with an approved account, alternative payment terms may be agreed. We reserve the right to require part or full payment in advance, especially for larger jobs or where there is a history of late payment.

If payment is not received when due, we may charge interest on overdue amounts at the statutory rate, and recover any reasonable costs incurred in seeking payment, including debt recovery and legal fees. Title to any goods or materials we may supply in connection with the Services will not pass to the Customer until full payment has been received.

Cancellation and Rescheduling

The Customer may cancel or reschedule a booking by giving us reasonable notice prior to the agreed collection time. We ask that you provide at least 24 hours notice wherever possible so we can reallocate our resources.

We reserve the right to charge a cancellation fee if you cancel or materially change the booking with less than 24 hours notice, or if our team attends the Premises and is unable to carry out the Services due to reasons within your control, such as no access, incorrect address details, or the Waste not being available for collection. Any such fee will reflect the reasonable costs incurred in attending or reserving capacity for your booking.

In the unlikely event that we need to cancel or reschedule your booking, we will use reasonable efforts to notify you as soon as practicable and offer an alternative date and time. We will not be liable for any losses arising from such cancellation or rescheduling, other than refunding any pre-payments made for Services that we do not provide.

Customer Conduct and Health and Safety

We are committed to carrying out rubbish collections in a safe and professional manner. Our operatives must be allowed to work without being subjected to abusive, threatening or inappropriate behaviour. We reserve the right to withdraw Services and leave the Premises if our staff reasonably believe that their safety or wellbeing is at risk.

The Customer must not ask our operatives to undertake any action that is unsafe, unlawful or outside the scope of the agreed Services. We may refuse to carry large or heavy items where doing so could pose a risk of injury or damage without appropriate equipment or adequate assistance. Customers are not required to assist with lifting or carrying, and any such assistance is entirely at their own risk.

Liability and Limitations

We will exercise reasonable care and skill when providing the Services. Our liability to the Customer for any loss or damage arising out of or in connection with the Services shall, to the fullest extent permitted by law, be limited to the amount paid or payable by the Customer for the specific Services giving rise to the claim.

We will not be liable for any indirect or consequential loss, loss of profit, loss of opportunity, loss of data, or any business interruption, whether arising in contract, tort including negligence or otherwise. We are not liable for any pre-existing damage to property, fixtures, fittings or items at the Premises. It is the Customer’s responsibility to protect any vulnerable surfaces, walls, floors or belongings that may be at risk during the removal of Waste.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be excluded or limited.

Any claim relating to damage or loss must be reported to us in writing within 48 hours of completion of the Services, providing reasonable details and evidence where available. Failure to notify us within this period may affect our ability to investigate and resolve the issue.

Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events or circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, lockouts, industrial disputes, accidents, breakdown of plant or machinery, war, terrorism, civil commotion, or compliance with any law or governmental order. In such circumstances, we may suspend or cancel the affected Services without liability, and will use reasonable efforts to inform you and, where possible, rearrange the booking.

Data Protection and Privacy

We may collect and process personal data relating to Customers for the purposes of arranging and providing the Services, handling payments, dealing with queries, and meeting our legal obligations. This may include contact details, address information, billing details and information about the Services supplied. We will handle personal data in accordance with applicable data protection legislation.

We may keep records of bookings, invoices and communications for a reasonable period as required for accounting, legal and operational purposes. Customers have certain rights in relation to their personal data, which may include the right to access, correct or request deletion of that data, subject to legal restrictions.

Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing full details of your concerns. We take complaints seriously and will endeavour to investigate and respond within a reasonable time frame.

We aim to resolve issues directly with Customers wherever possible. If a dispute cannot be resolved through our internal process, either party may pursue any remedies available under English law. Nothing in these Terms and Conditions affects your statutory rights.

Amendments to Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, legal requirements or industry practice. Any revised Terms and Conditions will apply to new bookings from the date they are published or otherwise communicated. For ongoing arrangements, we will provide reasonable notice of any significant changes.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided by Rubbish Collection Knightsbridge, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services, except that we retain the right to bring proceedings against the Customer in any other court of competent jurisdiction where appropriate.

Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between Rubbish Collection Knightsbridge and the Customer in relation to the Services. They supersede any prior understandings, statements or representations, whether oral or written, relating to the subject matter.

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.
